[p. 3] Memorandum of Agreement - made & entered into this 27th day of March 1863 between Isaac Henry Keene of No 8 Kennington Green Surrey Builder of the one part & James Whistler of Kings Road [illegible] No. 7a Queens Row West Chelsea Artist in the County of Middlesex Artist on of the other part

The sd Isaac Henry Keene for himself his heirs exors apro & admors [i.e. executors, administrators] & assigns hereby agrees to let and the sd Jas Whistler agrees to take for 3 years from the 25th day of March 1861 the All that house or dwelling - house & premises & living No. 7 Lindsey Row, Chelsea Middlesex at afsd [i.e. aforesaid] for the term of 3 years to be computed from the 25th day of March inst. at the [net?] yearly rent of £50 payable quarterly on all usual quarter days of payment free & clear of all deductions whatsoever (except property tax) only accept And the sd Jas. Whistler does hereby agrees to pay the sd rent & all taxes both Parlimentary & Parochial whether now made in existance existence or hereafter to be made including Highway rates sewer rates & mains drain rates - also to keep the sd House in good tenantable repair (fair wear & tear excepted) & especially to keep the glazed windows perfect & to leave the same frames at the end of the Tenancy [integral?] together with the [p. 4] fixtures enclosed within ment[ione]d in the Schedule hereunder written and that And the sd Jas. Whistler also agrees not to underlet the said house without the consent in writing of the sd Isaac Henry Keene will not suffer any public sale thereon the sd prem[is]es nor to use the house other than as a private dwelling house & place for carrying on his professional business as an Artist, & [and?] that in case default is shall be made by the sd Jas Whistler in payment of such the sd rent - or any portion for the space of 21 years days after the same shall have become payable or in the performance of this agreement in manner not afore said or should and further that if the sd house & premises shall be shut up & left empty it shall be lawful for the said Isaac Henry Keene his heirs admors & assns [i.e. assigns] or his or their agent or any other persons or persons to reenter & take possession of the sd house & premises as if the sd Jas Whistler had not never become a tenant thereof & therout & from thence utterly to expel eject him & all persons holding under him And & the sd Jas Whistler herby undertakes not to bring any action or actions suit or suits against the sd Isaac henry Keen or any other person or person for or in consequence of so take possession as over sd It & it is also agreed that such the remarks shall not prejudice the right of the said Isaac Henry Keene shall have the same to the usual remedies powers of distress should no distraint for rent in arrear have been

[p. 5] And the sd Isaac Henry Keene hereby agrees that upon paymt. of the sd rent the & [payment?] of this Agreemnt by sd Jas Whistler his Exors Admors or Ass.s that he & they shall & may peacably & quietly hold & enjoy the sd. premes without the interruption of him the sd Isaac Henry Keene his admors or ass.s

Isaac Henry Keene, builder, landlord of 7 Lindsey Row [more]. This is a draft for the lease of 7 Lindsey Row; see I. H. Keene to Rose, 24 February 1863, #11848, and 20 March 1863, #11856.

The document was probably written by Lawson James McCreary, clerk to the solicitor, J. A. Rose [more]; it has little punctuation, many legal abbreviations and spelling mistakes, and is difficult to read. '59a' is written at top left in another hand and may relate to J. A. Rose's collation of his legal papers.
